Question about cyber-privacy

Let's say you have a closed forum, completely private, and members are engaging in gossip and general b.s. including gripes and so forth. Now you have somebody who hires spies to copy the contents of the forum, and the contents of the posts appear at another site in order to embarrass and humiliate those who posted.

The original talkers said some uncomplimentary things about some people. The person who did the secondary posting of the ill-gotten posts at his website claims that he's been libeled by those who did the chattering because they have been saying stuff. Never does he challenge the factual nature of the things they said; he merely protests the fact that people have been saying them. Meanwhile, thousands of people are looking at the posts at the poster's website and snickering.

Question: How is this defined in a criminal vs. civil way? I think cyber-stalking falls under the jurisdiction of international law, doesn't it?

Edited to add: The webmaster in question makes it a regular practice to seek out and stalk those who are "talking about him," and breaking into forums using spies and hacks.

How would you define this mish-mosh situation?

Ridiculous. There is a reason why they are talking like that about him.
I'm not even sure I would define what the webmaster does as 'stalking', but in any case, I think your question as to how cyber-stalking is defined legally, is covered here:

So what you are saying is that someone hacked into the site and downloaded information and posted it; a site that is not public? That form of hacking is illegal and you should be calling RICO? RICOH? About it.

Now I am curious, how did this guy ever know that this other site existed? Is there a mole on the other site or was it information that can be viewed by the public? If the information is public, then I don't really think you have a huge ground to stand on. Perhaps for plagiarism or if he did not declare where his source were there are legal issues as he did not have permission to post your information. Since it was chatting, it could be a differant story.

This guy knows where all of his current and banned members are, because he keeps tabs on them. He'd like to think he can hunt down and destroy/expose/intimidate everybody who has a negative opinion not to talk about him. He will stalk, expose and ban from his site if you have spoken about him negatively anywhere. He will not stop until the forum is cracked open and its secrets revealed, and has been known to have sites taken down by using threats.

He recruits spies with access to copy the forum info in exchange for favoritism or other minor things, like a premium membership. His spies work cheap.

I will share the name of the site, but only through p.m.s as he's constantly trawling the internet looking for people talking about him. This guy is one sick puppy.
Interesting...he definetly needs help for sure! I think you have a strong case against this guy if you could prove that he is hacking the sites. Hacking as we all know is illegal.

I knew a guy like this. He hacked into a friends pc and got her bank information. He did not trust anyone and could not be trusted. He stalked my friend for a long time. He got into her dorm room one night. He even finished his University degree and left his fridge rented in the dorm room so legally he still had access to the dorm. We knew someone in the Admin office so we put a stop to that. He hacked her emails, everything. It never went as far as me having to instill a large amount of physical pain upon him, but it sounds like we are talking about a similar person...

Not likely, as I haven't typed the url in my post. This is a very unlikely place for him to look for somebody posting about him.

He's busy as we speak posting stolen forum content, smearing people and trying to prove to his members that there's a plot by these evildoers to destroy his life and business. So he's pretty occupied for now. Many of us wish somebody would hit him over the head with a frying pan and stuff him into a straightjacket, but he's still in the driver's seat and nobody's stopping him.

As I said earlier, I will gladly share the site info, but only in a p.m. and remember don't post it here.

No, he's only been posting things since yesterday. I wasn't sure what's illegal, if anything.
Well this is cyber bullying for sure. It seems as though people stay on the site out of fear. Hard to say what to do. Would he ever physically harm anyone? Would he ever hack into your home pc or bank accounts that are yours? If the answer is "no", I would leave the site and have nothing to do with him. Then again, if he then stalked me to keep track of me, that's illegal and I would bring him down.

I never hurts to speak with the RCMP (I think they're better equipt), and see what they say. We can really only specullate on things. They may say to change your site handles so he can't track you down and stay off his site. He may be capturing IPs and names of those who hit his site...
I don't know how far he would go. Right now, he's engaged in having a site shut down because his members and ex-members are talking about him. He and his staff are engaging a post blitzkrieg. I suspect him of hacking into my server at one point, but can't prove it.
I think without proof, you are outta luck. Call your ISP and let them know what's going on. They may be able to find something in the network logs and monitor closely.

You could always discuss him via pm to get him off your back.
