I have a couple questions regarding the notification.

1. I have gotten the notification twice but when I restart the computer it goes away. is it something I should be looking into getting looked at by Apple or just wait until it displays it constantly?

2. Is this covered in the Apple Care warranty? I do know that Apple doesn't cover batteries that have worn down due to use, but is this an exception?

The system is a Macbook pro 13" 2.26 Ghz 2009 model with upgraded HDD and RAM

Your local Apple Authorized Service Provider will be able to run a battery diagnostic to tell you whether the battery is malfunctioning or simply worn down. I've only seen Apple replace batteries older than one year on rare occasions, however.
