The tethered JB isn't an issue at all. I've not had the need to do a complete power shutdown on my V3 and it runs just as good as my jailbroken V2. My guess is they will swap it with a new V3.
BTW, if you are stuck on the V2, just don't open the V3 and sell it. The refurbed V2s come up on the refurb store occasionally for $169 (8gb). Shouldn't be hard to break even very quickly
