How will they make her pay the $5,000? I hate people like that smug and stupid a great combination, I would have liked to see and hear her husband that probably would have had me trying to reach for his neck.
I have to admit that I have never watched JJ on TV. However, why might a person bring a case to her? Does she have any actual legal standing/jurisdiction to force this fine?

Defendants don't pay the judgements on Judge Judy, they GET PAID to appear. That's why they agree to go through the humiliation.
Also, this would probably not have succeeded in a real court, because the auction clearly does say that it's for the picture only. It's dirty for sure, but a lot of people do things like this on ebay, you have to read the whole auction before bidding.

yes, i think the maximum damages the plaintiff can be rewarded is the same as how much they get paid, so by appearing on the show the worst the defendant can make out is even. Also i think they have to sign something that they agree to the judges decision and can't bring further legal claims.
Regarding your 2nd point, i think you're off. The auction listed the physical characteristics of a cell phone, so even if the auction says "you're bidding on the photo only" there is a conflict in what is being stated.
Furthermore, even if you DO buy the "photo only" angle, the plaintiff STILL has a claim that she was sent a PRINT OUT, and not a PHOTO.
I don't see how any court could ever side with the defendant.
Just FYI: it is standard practice in these sorts of shows, both parties have signed an agreement dropping their genuine legal action in favour of accepting the terms of the show, some of which have been spelled out in other posts. Interns scour the public notices of the small-claims courts to find "interesting" conflicts, approach the parties and see if they can get them to agree to drop the action in favour of being on TV/definitely getting at least some money or free trip out of it.

These guys are pretty careful in how they word the auctions so that it definitely says something other than what it first appears to. Judy wouldn't stop shrieking long enough to read the whole thing, she couldn't even find where it said 'picture only'. What they typically do is have a line where it says something to the effect of "here is a description of the item that you are buying a picture of".
I know for a fact that courts do regularly side with the defendant in such cases, because I know people who have been taken by this exact scam. They are particularly prevalent close to christmas when there is some hot new item that all the stores are sold out of. When the Wii was in short supply, there were loads of these kinds of auctions. Read the whole auction before bidding!!!
