I had a really bad week, a few weeks back. I was having bad luck at every turn. It got to the point where I wanted to just stay home and wait for my karma to improve.

Am I close?

I don't want to get sued from the company was working with...but I have hurt myself twice in 3 weeks and we are on the verge of being laid off without any warning. They took our piece work pay away and gave us back a crappy wage without warning (I now make $100 less a day..which is A LOT)

You'd only get sued if you broke your contract rules. If venting on ehMac about this company doesn't break your contract rules, they can't really sue you (as long as you are being honest).

Sounds like you know it's coming. Get out sooner rather than later.

If THEY broke terms of the contract, then you should so honour them with a trip to court. Small claims is fantastic for getting back small amounts (like $100 a day).

If you're injured, you should be on comp. If your union's idea of "modified" is taping drywall when you're a tile setter, there's something seriously wrong there. (yes, I read your original post)

I'm guessing it's a Labourer's union and not a trades specific union by the way they're allowing your pay structure to be altered at your employer's whim and making you work at different trades.

If you see the writing on the wall, get on comp now and later if you do get laid off EI should kick in. If they are forcing you to go on modified, refuse to do anything your doctor's report indicates you're not to do. Call the Labour Board and WSIB if there is a conflict.

Heal first before you end up with permanent health problems. If you need to supplement your income you could advertise on Craig's List and do small cash jobs. Visit every flooring store in the area and offer your services. Perhaps it's time to go independent, but getting over your injuries is priority.

I am in a union but from what I have heard it's for the company not the workers that work there (Union 183)

this is the letter we got from them last week. (img0073) This letter was given to about 15 people that were on piece work and now are back to a crappy wage!

When I hurt my back I went in to talk with the HR person and she is nasty! she said to me right off the bat that "she heard it was from a previous injury!" I was like where and how would you know? I have only been there 3 months! and I have never hurt my back before!

The place is going down...personally I am glad to see it happen....

I was on my own doing tile work for a long time but with the girlfriend in school for another 3 years I can't keep myself busy enough! which is why I went to work for Mattamy!

I am going in for xrays on my elbow and wrist today...lots of fun...

Your union sucks.

Then again, you've only been there for three months, so you wouldn't qualify for much in terms of protection or severance.

Does your Collective Agreement really allow your employer to change your position effective immediately? If that's the case, these are the conditions you agreed to when you went to work there.

About your injury: put your conversation in writing, as much as you remember, at least for your own purposes. It looks like they are getting ready to deny you whatever meagre benefits you are entitled to by saying it's a prior injury--or they were trying to trap you into agreeing that it was. Make sure they know, officially, that it wasn't.
