Problem with up to date and Media exchange

Looking for advice
A little while ago My wife bought me a G5 1.6 and according to the store I was eligible for the up to date program so I sent away the fax and recieved the dvd.
But sensei had been reading the forum and I realized that I needed the cd's. I sent back the dvd ,more money and waited. The other day a letter comes that I am not eligble for the media exchange. Phoning Apple (a painful story in itself ) I am told Apple produced no units that Qualified for the media exchange . Pause then who I say qualifies for the media exchange. Vast silence.
When the rep recovers she tells me my situation will be escaled and I will have an answer Monday.
What do you think do I stand a chance for the cd's at the least i want my money back(better yet the dvd).

A Power Mac G5 1.6 GHz features a Combo or SuperDrive - why do you need the CD version of Mac OS X "Tiger" v10.4?

I don't understand why you need CDs...unless you were planning on getting the up to date discs on CDs so you could upgrade your new Mac and your older ones too, which cannot be legally done (its only one license).

I'd have to agree with Apple here...unless they sold you a unit that is not capable of reading DVDs, there is no reason for you to get Up-to-Date CDs...from their standpoint it would seem as though you were just attempting to use the discs to upgrade multiple Macs.
