I just picked up a brand new 14" iBook from a local Toronto dealer, got it home, fired it up and I see that it has Panther (10.3.7) installed on it and not Tiger. I called the dealer who said that this unit was shipped to him before Tiger was available. No problem, I say, where do I pick up my free upgrade. He sent me a form for a "free" update from Apple. Problem is, the offer expired two weeks ago and free means a $9.95 US shipping charge. I called Apple Canada and they offered me the same "free" upgrade.
Anyone else had to deal with this? Who can I contact at Apple to get a real free upgrade? I know it's only $15 (Can), but why should I have to go through this crap on a brand new system?
I would demand it from the seller. Tell them.. I bought this iBook.. new. I should get the upgrade for Free. Plain and simple. He should order it for you.. end of story. If they don't.. there's something seriously wrong.
Maybe try another reseller? Or the Apple store if you're close?
If the reseller recieved the ibook as stock before the release of Tiger then they can't do anything for you. I would call Apple and make a big stink about it. Say you're very unhappy and will probably return the machine and go back to using a PC or something like that. Im sure theyll send the upgrade to you if you raise enough fuss
This happens all the time when a new Mac OS is released. (Stock Lag)

Apple offers the pay-the-shipping solution (Upgrade Tiger Discs) ....... thats it... period....!
I do not believe the iBooks have been updated since Tiger came out.... thus ALL iBooks will have Panther on them. ( I realize this is a broad statement but the odds are against having Tiger)
A little less than $15 and your blood pressure will return to normal, or harp about it over and over and over.
(IMO - the reseller should have warned of the possibility but ... I have seen it happen to many times to want to now stick it to the reseller, just order the discs.)
I ordered my iBook 3 Fridays ago, picked it up last Friday, it was a built-to-order iBook (upgraded to 60GB, bluetooth) and they gave me OSX Tiger. Well they had to assemble it when I ordered it which is why...
All iBooks sold at the Apple online store have Tiger on it too.
It's just like how major retailers often don't get new revisions of iPods until maybe a week later, before that time it's simply the old rev iPod.

I believe you should have either been charged less for the Ibook with 10.3 or had 10.4 provided uppon purchase. your seller is being greedy and a might bit abusive of a customer. I say Demand the disk fro your seller, if they fail to provide it, or seem genuine enough in their desire to help, ask them to provide/order it out of pocket. This should not be your loss.

Why not just pay the fee and then get Tiger for $10 then sell the Panther disk here on ehMac for say about $25 and make money instead of getting all uptight about it.
Why don't you put a little pressure on the reseller by giving up it's name on this forum? I 'm sure the publicity alone would cause some concern for them

It's not the reseller's job to do this. They were shipped the product before Apple released Tiger. It is Apple's responsiblity. Im sure if you are mad enough they will send you Tiger for free without you paying for shipping.
